<span style="font-family: "arial" , "helvetica" , sans-serif;"><span style="font-weight: normal;">Former Denville Councilman Gene Fitzpatrick has been selected as County College of Morris’ Outstanding Alumnus of the Year by the <span class="il">CCM</span> Alumni Foundation. He will be honored in a charity fundraising gala May 4th at the Hanover Marriott.</span></span><br />
<span style="font-family: "arial" , "helvetica" , sans-serif;"><span style="font-weight: normal;"><br /></span><span style="font-weight: normal;">Fitzpatrick graduated Denville’s Morris Catholic High School in Denville and chose to attend County College of Morris. “I was lacking direction despite the good high school education” claims Fitzpatrick. <span class="il">CCM</span> helped him explore different topics and courses to pursue his educational and career path. After graduating <span class="il">CCM</span> in 1992, Gene transferred to the University of Maryland where he would further refine the communication and marketing skills he first developed at <span class="il">CCM</span>. From there Fitzpatrick has gone on to great success as a marketing executive and community leader.</span></span><br />
<span style="font-family: "arial" , "helvetica" , sans-serif;"><span style="font-weight: normal;"><br /></span><span style="font-weight: normal;">Gene has helped steer digital marketing campaigns for many consumer and pharmaceutical brands. He currently is an SVP at Grey Healthcare Group, part of WPP’s Health and Wellness division which is one of the largest advertising agency networks in the world. He has also helped lead several other adverting agencies into the digital world and was a pioneer in social media co-producing one of the first podcasts, Hometown Tales. He credits his work at <span class="il">CCM</span>’s radio station (WCCM) for developing his broadcast production skills. Fitzpatrick served on Denville’s Town Council for 8 years and was also selected as Council President during Denville’s centennial year. During his service, Gene helped lead many rebuilding efforts resulting in the damage left from Hurricane Irene. Choosing not to seek re-election last year, Fitzpatrick still remains locally active as a board member for Downtown Denville’s Business Improvement District & The Foundation of Denville as well as additionally volunteering for other causes. His wife Wendy and 2 young boys are also part of that volunteering. </span></span><br />

The professionals, the responders, the Council and the Mayor-elect at the time were the right people in place. Denville had the right leadership and more importantly the unbelievable strength of our residents to rise above the water and rebuild stronger than ever. </div>

There are two other resources that are products of the outstanding foundation Denville provides. Two accomplishments in progress that I am most thankful for and proud of. They are in the audience this evening. One is 7 years old, Quintin and the other is 2, Zaeger. My sons who are benefiting from the greatest town to raise a family in, Denville. </div>

Their mom, and my wife Wendy, I also thank for being able to wrangle these 2 outstanding maniacs to bed at night alone and supporting me through 8 years. I believe it was worth it if we were able to keep one less drop of water from flooding our neighborhood, or that kept one more firetruck on our streets, or filled a downtown building with a store to enhance the experience of the best downtown in the county, or helped the best police department in the state stay well equipped and staffed. </div>

<span style="font-kerning: none;">There is a very active group, understandably upset, over the potential of a development on Casterline Road. I applaud them for their activism. Unfortunately, the issue is extremely complicated which is why I feel as a Councilman, I have to work much harder to communicate all the details of what’s happening. The reason for the development is essentially because the Township has a constitutional obligation to provide for the reasonable opportunity for the creation of affordable housing. The historical aspect of the constitutional mandate is another very complicated issue. I have outlined that situation in a previous post in April. <span style="font-kerning: none;">However, specific to the Casterline development, there are some flyers and a website (Ironically entitled the ‘Naked Truth’ which is leaving out A LOT of information ). In response, I want to try and clarify why we are in the situation we are in. I believe by the time the Council will actually vote for the rezoning change in the area to provide for the development I will have already left office; however, it’s important for residents to know the issue. I have offered to speak with this group several times but have not been invited. I will try again and sign up for their newsletter. Again, I am hopefully a reasonable solution can be found but I warn residents to be careful what we ask for. Some of the suggestions by this group will most likely lead to massive and costly litigation for Denville as well as even more higher density development that Denville would have no say or influence in. That risk is too great. I caution residents to question the credibility of someone passing our flyers to you at Acme the same way you’d question Denville’s Council. The Council has no vested stake in approving developments. The Council gains nothing from entertaining this issue except that we have to try and make the best decisions for the whole town and in doing so protect our town. </span></div>

We have always obliged to the various different formulas that have been provided/changed/revised by the state. We actually enter the current round with a slight surplus of affordable housing credits. The Fair Share Housing Center, a lobbying group and our adversary in the courts has proposed that NJ need many more affordable housing options a specifically nearly 1500 in Denville (which actually would mean 6000 total homes added in Denville, if you include the market rate units in that calculation. That’s double the town’s current housing).</span></div>

<span style="font-kerning: none;">With that, Denville and other municipalities resorted to court because the State legislature was unable to approve and develop appropriate guidelines for assigning an affordable housing obligation for each municipality. Last year, the court asked Denville to submit a proposal based upon calculations performed by our expert on how many new affordable housing units we were obligated for and how we would propose to accommodate the construction of these units. Since several other developers are part of that lawsuit, Denville had to provide solutions that would show some reasonable attempt at working with these interveners. Unfortunately, since it was a court matter, the governing body could not open those discussions to the public. The Council and Planning Board supported some potential ways to accommodate the developers, knowing that they were theoretical. Now, we are trying to determine and negotiate the best way to allow for responsible and smart development in various areas.</span></div>

<span style="font-kerning: none;">Several developers have joined the Fair Share Housing Center, positioning themselves as part of the “solution” to develop the quantity of homes the FSHC is asking for. In the past developer’s often would file builders remedy lawsuits which accused municipalities of unconstitutionally preventing them for being able to construct affordable housing. These lawsuits not only cost municipalities millions to dollars in court fees but almost always resulted in larger, higher density developments where the municipality was completely removed from the planning process. As well the courts in NJ have almost always sided with those developers. A way to avoid those lawsuits is to abide by the courts process and continue to “move forward” with a working path to smart development. This is what Denville has done.</span></div>

If the court agreed, Denville would lose ALL immunity to the Builder Remedy lawsuit. That means, ALL OF THE OTHER DEVELOPERS SEEKING HOUSING PROJECTS IN TOWN WOULD FOLLOW SUIT. That could cost Denville MILLIONS OF DOLLARS IN LEGALS FEES and RESULT IN MASSIVE DEVELOPMENT. Many times more that what we are entertaining now.</span></div>

A great example of that is the development on Old Boonton road and the smaller one on Church Street. </span></div>

I couldn't imagine who would ever want to be New Jersey's next governor. Our state is in such a terrible mess -enormous property taxes, insane state school funding formulas, a State pension fund so deep in the hole that 3 former governors at a League of Municipalities Conference recently agreed they wouldn't even know where to being in order to fix it. However, I'm very impressed with a candidate who has a plan and gives real answers to question vs. the same older political rhetoric. That candidate is Jack Ciattarelli, he's a businessman and resident first, before politics.<br />
<br />
I've never been one to shy away from disagreeing with my own political party but I believe Jack Ciattarelli is the best person to lead the state. The Primary selection for Governor should not be a coronation of an establishment's candidate that automatically assumes the nomination. It should be a contest and debate. In those debates Jack has demonstrated himself to be the better candidate. Here are the reasons why I'm supporting Jack Ciattarelli in the June 6th primary.<br />
<br />
<b>SCHOOL FUNDING</b> - Finally someone is admitting why our property taxes are so out of control and has a plan to fix it. The way the State funds our schools is all out of wack. Jack is pointing this out and vowing to change that formula. He acknowledges it will take bipartisan work in the legislature but already knows which Democratic Assemblypersons and Senators are open to support it. There is no reason why residents of Denville should be paying leagues more money for their schools than affluent property owners in Hoboken or Jersey City. We need a new fair funding formula.<br />
<br />
<b>TERM LIMTED</b> - I enthusiastically applaud how Jack has term-limited himself in every political position he's had. He believes politicians must NOT be a permanent part of a political machine. Jack is a business owner and resident first. He is not tied to a political establishment.<br />
<br />
<b>BENEFITS REFORM</b> - I point blank asked Jack how'd he accomplish this with a Legislature that is in the pockets of big unions. He has a plan. Jack knows he can lead support for school funding reform with key bipartisan support in suburban counties. Once that success is achieved he can leverage that equity for State benefits reform. All the stakeholders have to come together instead of the mudslinging and name-calling that has been happening for the last 8 years. It's time for a new and fair approach on both sides of the issue.<br />

<b>AFFORDABLE HOUSING</b> - It's a simple plan, get it out of the courts and back to the legislature. As Governor, Jack will appoint a fair council that will be committed to getting something done instead of being deadlocked in political stalemate. I'm proud of my political party but we need to put the state first over political parties and work across the aisle.<br />

<b>THE DMV</b> - Finally a NJ political figure is pointing out how inefficient the DMV is and wants to fix it.<br />
<br />
<b>HE CAN WIN IN NOVEMBER</b>- NJ voters lean heavy Democrat and the actions of this last administration and the National Republican Party over the last few years have nearly destroyed the party in NJ. Jack is putting NJ first and is the only one who has smart sound ideas that both Republicans and Democrats can agree with. We need to fix the the states finances ASAP and there is a way to do it without massive tax increases. Let's fix the wasteful inefficient state government. <br />

Ciattarreli's opponent Kim Gaudagno is a nice individual. I am grateful for the support she has shown Denville, but it's time for change. The accusations against Jack from her campaign are wrong. He is not looking to raise taxes, instead he is actually giving voters an honest and complete plan about how he will fix this economically dying state. I much rather a candidate that gives details instead of quick marketing tricks and sound bytes. Vote Jack Ciattarelli June 6th. He's a really impressive guy and the only hope we have to save NJ.<br />

7-11 is intersted in purchasing the old auto-garage across from Norman Dean Funeral Home in Denville. I'm not a huge fan of 7-11s and not too interested in one being so close to our downtown. It has the potential to disrupt the small-town feel Denville has.<br />

However, the area has been zoned for commercial/retail use for decades. And the owner of the property has a right to sell/open whatever type of establishment he/she wants as long as fits with the type of usage area has been zoned for. And despite my pre-conceived notions of what 7-11s look like, there are some newer 7-11s that are very presentable and work well within downtown districts. Morristown & Panther Valley are two examples.<br />
<br />
There certainly are others like myself, cautious about a 7-11 in our downtown. However, there is a misconception that the Planning Board meeting tomorrow night (<a href="http://www.denvillenj.org/docs/Boards/PlnngBoard/Agendas/2017/PB_Agenda_052417_SpecialMeeting.pdf" target="_blank">Weds, May 24th</a>) has the option to reject a -7-11 from coming to that location. Unfortunately, that is most likely not going to happen. The Planning Board is not deciding whether to allow 7-11 to open. They are deciding as to whether they grant 7-11 variances for sign usage and front yard setback. Local governments can not be specific about types of establishments property owners can open. I' ve heard people say "it'd be ok if it were a WAWA". Well that's illegal and unconstitutional. None of us should support governments restricting establishments based on our whether they like that establishment. This is America. Citizens can open businesses on private property they choose as long as they are legal businesses abiding by the laws of that location. Other than those use variances the owners of the property do not need "township" approval to open a 7-11. I might also note that outside of being illegal, restricting an establishment from opening due to unsubstantiated stigmas of that establishment would easily result in costing Denville taxpayers tens of thousands of dollars. Naturally any property owner would sue the Township if we restricted them, which is unbelievable costly to taxpayers.<br />

<b>SO WHAT CAN WE DO?</b><br />

The Planning Board can request the applicant (7-11) make remedies to accommodate parking, traffic, etc.. but can't say "no we don't want a 7-11". It can also be an opportunity to ask the 7-11 owners to do other things to help the neighborhood. (They wouldn't be contingent on approval but it doesn't hurt to ask) So I encourage everyone who is concerned about those implications to attend the meeting and ask questions during the public portion. The Planning Board is made up of fellow Denville residents just like ourselves. None of them have any vested interest or benefit in whether a 7-11 is there or not. I have confidence they'll make the right decisions for our town and I encourage residents to discuss these matters with the Planning Board.<br />

One of which is a possible Redevelopment along Route 53 which would be about 8 affordable units and the rest mid-high end units. Keep in mind this would satisfy about 16-18 units of obligation due to various incentives, etc.. I have a lot of concerns about this re-development but we have to look at it.</span></span></li>

<b>ARE APARTMENTS BEING BUILT?</b></div>

Not necessarily and not for a while and <b>NOT 100</b>. That has never been discussed. Early ideas were around 57-60 units and even that is not approved yet. From this Councilperson's perspective, I (and the rest of the Council) have only approved the area, where the abandoned printing facility on Route 53 is, be submitted as a "Rehabilitation Area". There will be many public meetings, proposals, reviews and more over the next few years to determine. <b> ALSO THE REASON WHY THIS IS EVEN A CONSIDERATION IS THE NJ COURTS ARE FORCING TOWNS TO DEVELOP TO ALLOW FOR AFFORDABLE HOUSING OBLIGATIONS </b>which is incredibly frustrating and we have a right to be angry. Denville believes we have met our "Fair Share" housing obligation but the FAIR SHARE HOUSING COUCIL is claiming we need another 1313 affordable units (which mean over 6000 total units. It's INSANE) We are waiting for the courts to decide but in order to keep from being sued by developers (who can sue to develop anywhere they want to any density), we have to keep "moving forward" to a plan. The court's have not determined what "moving forward" means.</div>

<b>WHAT DOES "REHABILITATION" MEAN?</b></div>

The state allows us certain advantages for redevelopment. I approve of allowing that area to have "redevelopment". Currently, another factory could open up there tomorrow without requiring any approval. They could come in and have 150 employees going in and out each day. So at some point there will be something built there again. I believe it's best for us to insure it can be the right fit for our town and options where we can have certain requirements.</div>

<b>WHAT ABOUT TRAFFIC?</b></div>

A <b>MAJOR</b> concern for me. Traffic on 53 is horrible. I need to see more traffic studies on how a development there will work. But again, a factory could open up there tomorrow without any approval and supply 150 people commuting in and out of town everyday. Traffic is going to get worse everywhere in our state. And Route 53 will be a challenge especially when something is developed in Morris Plains where the old Warner Lambert facility was. We have more people in this area overall. The challenge is finding the balance of good traffic flow. I'm committed to finding that. Can NJ expand Route 53? Can we re-route traffic a certain way? That's what I am hoping to find out and may be contingent on whether I would support this project going forward.</div>

This is an important question that needs to be answered. Another one, how much will any development affect other Township resources? Although traditionally, transit villages have had less of an effect to those resources. I still need to see more info. And again, the total number of units seen so far was around 57-60.<br />

<b>WHAT'S THIS ABOUT AFFORDABLE HOUSING?</b><br />
Essentially this is the only reason the rehabilitation area and a POSSIBLE transit village complex is even being remotely considered. <b>DENVILLE IS BEING FORCED BY NJ COURTS TO BUILD A SPECIFIC NUMBER OF AFFORDABLE HOUSING UNITS.</b> Blame the NJ legislatures, blame the Governor-The NJ Council on Affordable Housing has done nothing to provide guidance to municpalitieis trying to accommodate fair housing. Now the NJ Courts are telling towns how many affordable housing units they need to build but unclear direction on how that formula is being calculated. A "possible" complex would satisfy some of those obligations due to various factors even though many of the units will be higher priced models. <b>DENVILLE RESIDENTS SHOULD BE FURIOUS ABOUT THIS AS AM I. </b> I will be speaking more on this and looking for residents to help us find solutions to combat this. <b>ARE THESE ALL AFFORDABLE HOUSING? ARE THEY "PROJECTS"?</b><br />
No. Only 8-9 of potentially 57-60 are affordable. However, those will count double to our affordable housing requirements. No developer wants to just build affordable units because they want to make money. Plus, it is wrong and unfair to stick all affordable units and their residents into one complex. That would essentially be "project" housing which in my opinion is almost unconstitutional. They should be able to have the same quality access to a community. However, in order to accommodate for potential what the NJ Courts will mandate our affordable unit requirements to be, developers will want to build many non-affordable units. For every affordable unit the state requires us to build, expect a developer to build 5 higher end units.<br />

<b>WHY BUILD THEM THERE?</b><br />
We can't dictate to a developer where he wants to build a property but we do have a Master Plan and we do zone areas of our town. There is not much space left in Denville to build something new. However, there are places where commercial establishments once were they are zoned for development. Route 53 is one of those areas. Keep in mind that an industrial/commercial property could open up in this same location tomorrow and add 150 cars to rush hour traffic along Route 53 and they would not need any approval. That's why a residential property and rehabilitation zone should be considered. With that, our Township can specify certain improvements to the area. We can request certain requirements for parking, sidewalk, traffic flow and more.<br />

<b>IS THIS CORRUPT GOVERNMENT?</b><br />
First, remember Denville's review of this possible scenario is still just a review. This will take years. Every mention of the proposed area has been done in public meetings. The Council is made up of volunteers. I personally have absolutely nothing to gain by a development being built in that area. As a matter of fact, as a resident who commutes that route every day, I am <b>EXTREMELY</b> concerned about the potential traffic. Although I do recognize that traffic is not going to get better on Route 53 and if the Township does nothing ever again on 53, more stores, shops and more commuters will still show up on this route. Anybody who is charging that somehow "Denville officials" are getting some benefit from this is greatly misinformed and frankly a bit ignorant to how government functions. I encourage all residents to come out to Town Council & Planning Board meetings and get involved. We've actually had a few residents that have come with many good questions and suggestions. Please don't just sit back and criticize decisions. Instead, be part of the conversation and help the town make the right decisions. <b> Ultimately, no decision on this matter will be perfect but we have to plan something.</b></div>

At a recent Republican County Committee Candidates Night in Denville I was surprised by exaggerated remarks by my fellow Councilman, Kevin Scollans. He claimed Denville has a major debt problem and there was a lack of transparency about it. That is shocking to because Denville has one of the lowest debts in all of Morris County and Denville has an outstanding credit rating as well as lower municipal taxes. New Jersey is one of the most densely populated states and Morris County has some of the highest property taxes. This is a huge problem that all of us our frustrated with. Denville’s local government has been working extra hard these past few years to dampen tax burdens. We’ve done it with extensive grant applications, government efficiencies, township improvements that attract businesses and pressuring state reform.</div>

As far as transparency, the municipal budget is discussed publicly for months at the beginning of each year. The budget is available online and at Town Hall for anyone to review. <br />

If Councilman Scollans wants transparency, he should make sure he is transparent as well. His claim left out how Denville bonds at an unbelievably low interest rate, unlike debt that you or I have from credit cards or mortgages, This year we bonded for less that 1%. That’s an exceptionally low interest rate! At rates that favorable, we need to take advantage of responsible lending. Very similar to why it often makes good sense to mortgage a home within your means. Low interest loans can make good financial sense. As well, some of our debt is the result of the damage caused by Hurricane Irene which destroyed the Valleyview Firehouse and other town infrastructure. Once FEMA reimbursement is finalized, our debt will go down significantly. That should have been mentioned.</div>

Why does the town have debt? More expensive items such as fire trucks, ambulances or long term capital projects can be very pricey. It would be irresponsible to hit taxpayers with that cost in one year. Large Township improvements or a new vehicles benefit residents for many years, sometimes up to 20 years. It wouldn’t be fair to force current Denville residents to pay a huge amount of money for something that will be used by our Township for many years ahead. Could you imagine how high taxes would be on years where we need a new firetruck if we paid it in cash? A current resident footing the bill for an item that many generations will benefit from in the future is grossly unfair. Some loans are worth it because we have such low interest we can spread that cost responsibly over time without having a bank-breaking tax impact. Each year during our budget workshops many Council members, including myself, carefully watch our debt schedule. We are fortunate to have a sensible Township finance officer, Mike Guarino, and an independent auditor who help keep Denville’s financial stability one of the best in the county.</div>

THINGS TO REMEMBER ABOUT A MUNICIPAL BUDGET<br />
<br />
- About 2/3rds of your property taxes go to our schools (Regional H.S. and Denville)<br />
- The Municipal Budget portion is under 20% of your overall taxes<br />
- The Township is still responsible to collect all the taxes and pay the Schools & County after the collection. This can obviously be a challenge because whether the taxes are collected or not, the Township still has to pay the School & County portion. Often it has to front the money.<br />
- There are many predetermined items in the budget due to State and Federal regulations, existing Union Contracts, etc..<br />

I SUPPORT THIS BUDGET<br />
<br />
First I support the municipal budget that was introduced. I continually push for lower taxes and more efficient government. We are improving greatly. However, we will be faced with a small tax increase again this year. It is just under a 2% increase, which is about 30 something dollars to the average Denville household. However, I believe this is a responsible budget especially looking ahead at future years. As well, the main reason for the slight increase is something beyond a Councilperson's control. We had a huge tax appeal by one of our biggest ratables over the last two years. It is fundamental that we pass a budget or else we can not do anything in town. The governing body has to pass a budget. I am very against when a Council member votes against a budget, unless they have shown very clearly how they would change the budget.<br />

TAX APPEAL<br />
<br />
Franciscan Oaks, files an enormous tax appeal of several million dollars that was settled a short time ago with Denville's tax assessor. Most townships could be put out of business from this tax appeal or would be forced to have an enormous tax increase. However, credit to the Townships Administrator, Director of Finance and our Township Auditors, we were able to quell that huge storm from conservative fiscal management over the last few years. That appeal will be paid off this year. If the appeal didn't happen, Denville residents would have seen a significant tax decrase of nearly $20 on the average household.<br />

EFFICIENT GOVERNMENT<br />
<br />
When looking back over the years I have been on the Council, We have had the slightest tax increases in Denville's history, short of some years that there has been no tax increase. However, nearly every time there was no increase in the municipal budget, the township was hit with a very large tax increase the following year. Generally I am weary of budgets that have no increase whatsoever during a time where so many other costs are going up. This historically has appeared to be politically motivated in years past from my perspective. There would be a no tax increase during an election year but then the following year the budget would be in horrible shape and require a huge tax increase. <br />

OTHER COSTS<br />
<br />
Many of the other costs of the municipal budget are difficult costs to control such as negotiated union employee contracts, benefits and health care (which is greatly rising everywhere). Additionally , we have managed to maintain Denville services very efficiently over the last few years without interrupting quality.<br />

THINGS LOOKING GOOD FOR NEXT YEAR<br />

A budget also must be looked at over several years. While we had a small increase this year, there are signs that next year can be a very positive year in terms of Denville's budget. I really am hopeful for potentially a budget next year that barely has an increase. The reason why I think this is possible is because it is likely that Saint Clare's hospital will go private and pay taxes and we will most likely have a large new ratable with the residential area in development by the train station.<br />

This is NOT ordered by the Township, The Mayor or the Council. The township has not be revaluated in 15 years. The Administration is required to help facilitate the means of the revaluation.<br />

In the next few weeks you will be receiving letters from <a href="http://www.asinj.com/">Appraisal Systems</a>, a contracted organization that will conduct the revaluation. There will be field reps coming to your neighborhood. A rep takes information about your property and then eventually Appraisal Systems will determine a value. You will be able to see the value from that appraisal and have the opportunity to question or provide information before the final value is set and give to Denville's Tax Assessor. <br />

DO I HAVE TO LET THE REPS IN?<br />

Constitutionally, you do not have to let anyone in your home without a warrant but it is the best way for the appraisal to be completed. If you are unavailable for an interior inspection, it can be rescheduled. If field reps are not able to inspect the inside of your home they will assume the highest value of interior conditions. They will be inspecting in the next few months. The field reps will be showing ID and you will have know their names and what they look like via notification from the mailing and from <a href="http://www.asinj.com/">Appraisal Systems website.</a><br />

WILL MY PROPERTY TAXES GO UP?<br />

Some will go up, some will go down, some will stay the same based on the value of your home.<br />

For many years along Estling Lake Road, there has been an abandoned factory. It has been a constant eyesore for the neighborhood. As well, it has attracted vandalism, trespassing and environmental issues.<br />

I personally have always been a proponent of cleaning up areas like these. A proposal came forward to rehabilitate the area through a state program that benefits Denville greatly.<br />
<br />
<h3>
<b>WHY THE ABANDONED FACTORY HAD TO GO</b></h3>
<b>It was an eyesore.</b><br />
Abandoned, prone to vandalism and an environmental disaster.<br />
<br />
<b>It would have never been a park.</b><br />
The area was zoned for industrial use. Meaning another factory or industrial facility could relocate there will very little the town or neighborhood could say about it. I personally don't think we need 100+ employees commuting to that small road and building. I don't think we need trucks operating 24-hours a day at that location. And the way it was currently zoned, that could have happened.<br />

<b>WHY THE RESIDENTIAL FACILITY IS THE BEST OPTION</b></h3>

<b>Remaning zoned for industrial is not an option. </b>Another industrial plant in that location would be far worse. By doing nothing, an industrial plant could open there with little restrictions.</div>

<b>It allows for greater environmental cleanup.</b></div>

Zoning for residential use forces the area to be cleaned to a higher environmental standard. If we kept it industrial, the requirements for environmental cleanup are less. Having this area cleaned is crucial for the neighborhood and the surrounding waterways.</div>

<div>
<b>It allows for an access road to be constructed.</b></div>
<div>
There is only one way in and out of Estling Lake Road blocked by a train line. And when there is a major crisis like a fire or a major storm that blocks that road, there is no way for emergency vehicles to get through. By choosing to be part of this state rehabilitation project, we are able to receive money from the developer that can be specifically used for neighborhood improvements. An access road is a tremendous cost. There would be no way Denville could afford this without being part of this program. As well, if this area was kept "industrial", a factory could have moved in adding the same amount of traffic (if not more) but no access road would be created. This would be a huge loss and danger<br />
<br />
<b>Residents take pride in neighborhoods</b><br />
Again it would be ideal to just have a nice open park in the area but that will never be possible. It was zoned industrial. A small residential development is the best option. I believe having residents living in this high-end apartments will provide neighbors who care more about their surroundings that workers who just come to the area for their industrial job.<br />
<br />
<b>An OPTION for the neighborhood to have a sewer hookup</b><br />
Since a residential development will be constructed there will be a sewer line run to the property for the development. This also means that area residents can choose to hook up to this line without having a tax assesement for installation of the main line to the area.<br />
<br />
<b>Tax Deferment Pays Denville More in the Long Run</b><br />
As part of this program, Denville will grant the delay of certain taxes to the developer. However, this doesn't mean a tax break or any kind of favoritism. It is in a way "a payment program" that actually generates more money for Denville in the long run. Because of the State rehabilitation program we are able to defer the property tax until further along the development. However, the taxes which will Denville receives are much greater later, generating a much higher ratable for this property which provides Denville funding for Denville's resources down the line.<br />
<br />
<b>A complex with low impact to our schools</b><br />
This development is only about 100 units and catered towards commuter rental. That demographic usually means a low impact of added children to our schools, thus adding a burden on our school system. Years ago, there was a developer that wanted to build nearly 400 unit along the hill. This is the best option for development and will keep another worse development from being constructed.<br />

<b>COAH benefits</b><br />
The development counts towards state requirements for affordable housing.<br />
<br />
Obviously, with any decision like this, there is not a perfect solution but weighing the risks vs. benefits I support this rehabilitation program. I find the benefits are much greater than the risks but acknowledge those risks must be carefully monitored. As stated, this can't stay an abandoned factory and I don't feel another industrial plant is appropriate either. There have been large residential developments proposed in the past for this property. But this one is much smaller and will help prevent large obstructions like that from being at this location. As well, being able to put a much needed emergency access road could never help without this rehabilitation program and development.<br />

So in summary, 1) the abandoned facade has to go 2) the environment has to be cleaned 3) the only way to get an access road was this development 4) the best way to provide a sewer option was this 5) an newer industrial plant is also not an option 6) waiting for a larger residential project is not an option and 7) doing nothing is not an option</div>

<b>TRAFFIC</b><br />

Traffic is always a problem. It's one of the most common issues brought to my attention in Denville. Naturally, as our population grows, we have more people traveling through our town. You may have noticed an increase in traffic on Route 53 northbound in the early commuting hours. I have. I sit in it everyday. It is awful.<br />
<br />
This is most likely due to the increased and endless construction on Route 80 and Route 287. However, Route 53 is a State road so any traffic remediation would have to come from them. Traffic studies would be performed by them as well. Denville has requested studies along Route 53 but these were mostly towards the Morris County VoTech.<br />
<br />
<b>GRIDLOCK BY INDIAN ROAD</b><br />
<br />
In response to a few comments regarding the intersection of Route 53 and Indian Road I have asked Denville's Administration to mention the issues to our contacts at the Department of Transportation. As well, I asked that the Denville PD keep a monitor on the "gridlock" that has been occurring. Perhaps the State could simply add a "Don't block the box" sign along Route 53. I also encourage residents to reach out to their State Representatives, <a href="http://www.njleg.state.nj.us/members/bio.asp?Leg=321" target="_blank">Assemblyman Bucco </a>and <a href="http://bucco.senatenj.com/contact.php" target="_blank">Senator Bucco</a>. They have always been extremely helpful in representing Denville's concerns. The more avenues we approach about this situation the better. <b>DEVELOPMENT ON ROUTE 53?</b><br />

As far as the rest of Route 53, there may be traffic challenges ahead. There are properties that will be sold, occupied and rented that may increase or decrease traffic. We are unable to forbid existing structures from occupying or even developing at certain locations that are already planned and designated for use. There will be an additional development by the Denville Train Station where the abandoned cardboard factory once was. But traffic studies and modifications were required and we can not cease a property owner from selling a property designated for use to a buyer to occupy. I personally think a residential property at the factory was a much better option than it becoming another operational industrial building flooding our town with outsider commuter traffic that often has little regard for a neighborhood they don't live in. (I will outline that in a separate entry on this site)<br />

As well, I'm sure there are developer's and investor's proposals with potential plans for various spots on Route 53, as there are for most roads. That's business. However, that does not mean that just because a developer has an idea for something along that road it will ever happen. To immediately dispel a rumor, there is nothing officially proceeding via Denville's government for the old Redmond Press location ! As with any available property, I'm sure there are plenty of people with plans but nothing has gotten to the Town Council, Planning Board or Board of Adjustment. Be cautious of rumors based on hearsay. In 2013, the Denville Town Council approved the funding of an
in-depth engineering study into Denville's Rivers and Flooding issues.
This was the first of its kind ever performed specifically for
Denville. It was performed by our contracted engineering firm, Hatch
Mott McDonald, an engineering firm with extensive experience in flood
mitigation and river maintenance. The firm was originally hired by
previous Mayor Ted Hussa's administration and was maintained by Mayor

<b>FLOODING STUDY FOR DENVILLE</b><br />

After the first phase on this study, which was unveiled at several public meetings, there were some sobering results. Short of multi-million dollar programs that Denville alone could never afford, there were not many "home run" solutions to eliminate the risk of flooding throughout Denvile. However, there were some small steps that could make a difference to minor flooding. Flooding like we experienced from Hurricane Irene may not be preventable but smaller floods can be mitigated.<br />

<b>Some of The Study's Suggestions Were:</b><br />

- Flap Valves (just completed)<br />
- Desnagging (currently in process from a grant the town received)<br />
- Continual Extensive Cleaning (performed twice a year for the last few years with nearly 200 volunteers each time)<br />
- Storm Drain Repair & Cleaning (recently completed)<br />
- Coordination of Area Lake's Dam Release (currently petitioned as a law via the State Legislature but also granted from Shongum Lake by a Court Order that Denville pursued)<br />

<b>SMALL STEPS DENVILLE CAN AFFORD</b><br />
<br />
All of these small improvements were attainable by Denville with smaller costs spread out over the course of several years. This is probably the most attention to flood mitigation Denville has ever been given, most likely the most progress on flood mitigation in several years. In addition, Denville completed the herculean task of buying out homes, in a devastated heavily flooded area, using FEMA funding. We were the first town in the state to take advantage of this program. The bought out properties will now be a park (and retention basis) along Riverside Drive, soon to open in a few weeks.<br />
<br />
A small step that would help mitigate some of the flooding that occurs along Diamond Spring Road was to remove large structures that reside in the river by the La Cucina restaurant. This would not prevent major floods like the one Hurricane Irene caused. However, it will help the minor flooding that many may experience during less severe storms. Whether you are flooded by 1 inch of water or 6, it is devastating to a homeowner. I have helped clean the river along those piers, the buildup and backup along those piers is extreme. Despite cleanup efforts, the buildup continues and impedes the river's flow.<br />

<b>ALL COUNCIL MEMBERS APPROVED THE FUNDING</b><br />
<b><br /></b>
The entire council approved the funding for all of these efforts including the pier removal. However, the contingent was that the Administration needed to follow proper State environmental and historic processes. The Administration did that and the State approved the project. The Administration also agreed to provide historic markers in the area as well as keep one pier which was not a threat to the river. The benefits of protecting our residents homes outweigh the historical significance of the unmaintained cement covered piers. I am a huge supporter of historic preservation. In fact, I produced and pitched a historical documentary series to the History Channel and other outlets many years ago. I appreciate and value historic preservation. However, we need to protect our residents first. <br />

<b>A FEW THINGS TO NOTE ABOUT THIS PROJECT</b><br />
<br />
1) Even someone without a historic scholastic background can observe the historical portion of the piers has already been heavily compromised. Whatever original structure once existed appears to be solidly covered in more modern cement. (One removed, perhaps the original structures can be uncovered?)<br />
<br />
2) Those <b>piers accumulate enormous snagging</b> along the river and other than River Cleanup Volunteers, no other organization has volunteered to maintain the piers. Not the Canal Society, Not any historical society, no one !<br />
<br />
3) Removing 2 of those piers was determined to <b>help flood mitigation</b> by a professional engineering firm with extensive experience and credentials in flood mitigation. I am offended by the few opponents to this program who have no credentials or expertise in this area.<br />
<br />
4) The <b>entire Town Council approved the funding</b> of the removal of these piers provided the above conditions are met. <br />
<br />
5) During the removal, there will be state <b>officials present </b>including an archeologist monitoring the process and result.<br />
<br />
6) Once removed, the<b> remains of the piers are available for any interested party</b>. As well, the Administration has offered to work with any organization to recognize the historical area with markers or other informative displays. Something that is greatly lacking in the area.<br />
<br />
<b>LET'S RECOGNIZE THIS HISTORIC AREA</b><br />
<br />
I am still in support of the removal of these piers, provided the process outlined is followed.<br />
I also support and encourage any organization to utilize anything that can be salvaged from within the cement blocks for historic preservation. Let's preserve history but also provide a safe environment for our neighbors.<br />

It has been an unbelievably long and trying process to get these homes closed and then the process of gaining approvals from the utility companies and contractors to remove them but we are almost there.<br />

The next step is "Rain Gardens". This will essentially be a natural environment that will also act to absorb and maintain water without impervious coverage. This can be maintained with attractive landscape and a natural surrounding. The township can provide support through our Department of Public Works and other services but a project this big will require massive community involvement, ideally from that neighborhood.<br />
<br />
The Denville Administration and Township Council will now begin exploring the funding of this endeavor as well as appropriate planning. Once that is complete we are hoping to have some of our volunteer organizations helping creating an attractive Riverside area that protects and preserves the neighborhood from excessive flooding.<br />

Denville has a great opportunity to take advantage of recently awarded grant money to make improvements to our downtown district.<br />

I am so excited about this prospect. The Downtown Economic Advisory Committee has agreed on a recommendation for Phase 1 of improvements that include new period-style light fixtures, sound improvements, landscape improvements, the addition of brick pavers on much of the sidewalks and more. As Council President, I agreed to make every effort to have this plan brought before the Town Council by our regular council meeting in July. Provided the Administration is able to finalize their presentation and recommendation, it should not be a problem to move this along quickly.<br />
<br />
There are also several grants identified in upcoming years that can help fund further phases of the project. We expect this may be a 10 year complete project but hopefully Phase 1 can begin by next year. Phase 1 would focus along Broadway from Diamond Spring Road to First Avenue.<br />

We are still investigating why we are not going to be recommended for the Freeholders to approve.</div><div><br /></div><div><u>but....</u></div><div><br /></div><div><b>There have been other major developments.</b> Freeholder Director Chegwidden is meeting with Mayor Andes tomorrow morning. They have been working on a way to complete the project despite not receiving the Grant. They have arranged to get all the upstream Mayor's together to discuss an immediate plan. I spoke with Freeholder Director Chegwidden tonight and he said that he is very sympathetic to Denville's problem and is committing to working with Denville to still get this done. He believes even without the Grant money, the surrounding towns and County can complete this project. To ask the Freeholders to reject an independent Subcommittee's recommendation because Denville was not a recipient of the aid, would be nearly impossible. Although he is very sympathetic to Denville's issue, never have Freeholders voted against an independent non-political subcommittee awarding Federal money. He thinks that would not solve anything. But he is committed to getting the project done even without he Grant.</div><div><br /></div><div>However,.....</div><div><br /></div><div> we still need to show support. I will still attend the Freeholders Public Meeting this Weds, March 28th, at 7:30 pm and will speak during the public portion. I will thank them in advance for their support of somehow aiding Denville but I will also remind them how important our cause is.</div><div>While I believe we will have Freeholder Chegwidden, Freeholder Feyl, Freeholder Murphy and Freeholder Cabana's support, we need to have a majority of the board. The project was initiated many years ago and the Council last Tuesday was only deciding about whether the current assessment for each property was fairly done.</p> <p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Helvetica; min-height: 14.0px"><br /></p> <p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Helvetica"><br /></p><p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Helvetica">I was not on the Council when the project was initiated. Actually, only one current Council Member was. So during this meeting I was not making any decision regarding how the project came about or whether or not the process was the best route. We were simply deciding if the assessments of the final project were correct.</p> <p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Helvetica; min-height: 14.0px"><br /></p> <p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Helvetica">There was a citizen advisory board for the project to watch over the assessor and assessment company. We heard a lot of feedback from many current residents regarding the project and the assessment but I felt that all questions were answered. If there are any outstanding issues, there is an appeal process through the courts. For the most part it appeared that things were in order. Most importantly I gave great value to the Citizen Advisory Board. It was made up of citizens that were understanding of other residents. There testimony was powerful. There were huge problems with the sewer project and how it was communicated to residents but this assessment was fair when applying it to the project. And that was what the Council was voting on Tuesday, February 14th.</p> <p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Helvetica; min-height: 14.0px"><br /></p> <p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Helvetica">The Council unanimously approved the assessment. This was not an approval of all of the components of the project but only on the assessment aspect. Any residents that still have a dispute with that assessment, which didn't appeared to be a relatively small amount, have a legal avenue to still appeal and should proceed in that way. That will soon become a Picatinny Federal Credit Union. Some people are often disappointed when seeing so many banks around town. However, something to keep in mind; Federal Credit Unions are extremely important in these tough financial times. Many financial experts recommend Federal Credit Unions over Banks. Denville residents haven't had many options for Federal Credit Unions in the past so it is an important business to have located in town. Something in disrepair and on display that long is essentially pollution and affects other businesses.</li></ul><ul><li>All the other areas of the ordinance affecting residents have been in effect since the late 70s</li></ul><ul><li>The ordinance is locally enforced.
